Description of Job Duties The position involves defense litigation in both state and Federal courts as well as before the Personnel Board. The position has a significant emphasis on personnel issues and cases and previous experience with personnel issues will be helpful. The position will require practice in an administrative hearing setting. It also involves providing assistance with and opinions related to open records requests and the defense of open records appeals to the Attorney General. Cases may also involve other types of complex constitutional and statutory litigation related to the rights of state prisoners. Cases are practiced through appeal in both state and Federal courts. Brief writing and compliance with applicable rules of appellate practice will be required. Good investigation, research and writing skills will be necessary. The position will also involve drafting and promulgating administrative regulations, so experience with the administrative regulation process is preferred. The position requires a high degree of self-management and the skill and ability necessary to effectively litigate complex cases with minimal oversight. Provide legal representation for the Cabinet, its agencies and employees in state and federal forums [primarily related to employment law and personnel matters]. Litigate in state and federal courts and administrative hearings. Interview witnesses, prepare and file pleadings, motions, responses, memoranda of law, briefs and other documents as needed or advantageous in cases. Provide legal representation for the cabinet in Personnel Board appeals, and proceedings before the Equal Employment Opportunity Commission (EEOC) and Kentucky Human Rights Commission (KHRC). Handle KOSHA issues as needed. Provide legal representation for the Cabinet, its agencies and employees in appeals filed under the Open Records Act. Advise Cabinet and agency staff on open records issues. Draft and review proposed legislation, administrative regulations and internal policies as needed. Advise Cabinet and Agency staff on personnel and EEO issues. Handle prisoner sentence adjustment cases in state court.
