Job Description: The Western District of Tennessee, U.S. Attorney's Office has an opening for an attorney to enter as an Assistant United States Attorney (AUSA) in the Civil Division. Our Civil Division investigates and prosecutes affirmative civil cases on behalf of the United States as wells as defends the United States in a variety of defensive actions. The current position is for an experienced attorney who has a strong civil litigation background for the position of AUSA, with a primary focus on Affirmative Civil Enforcement and pursuing claims under the Federal False Claims Act. Attorneys doing this work are responsible for the investigation and prosecution of a variety of civil cases. These may include actions in which there have been false or fraudulent claims or false statements made to the United States, violations of the Controlled Substances Act, violations of federal civil rights or environmental laws, and other types of cases. The position will focus on representing the United States in all Affirmative Civil Enforcement actions as well as the districts qui tam litigation. A strong emphasis on civil prosecution of health care offenses is expected. The AUSA's duties will include: providing direction to law enforcement agents investigating violations of the Federal False Claims Act; reviewing and analyzing large volumes of records; conducting depositions and other civil discovery; drafting civil complaints and trying civil cases before the United States District Court; and representing the United States in civil appeals before the Sixth Circuit Court of Appeals. Candidates should be capable of handling a high volume and wide variety of significant and complex civil prosecutions. Responsibilities will increase and assignments will become more complex as your training and experience progress. The position is located at our main office in Memphis, Tennessee. Type of Position: This is a permanent position. However, all initial attorney appointments to the Department of Justice are made on a 14 month (temporary) basis pending favorable adjudication of a background investigation. Initial appointment is conditioned upon a satisfactory pre-employment adjudication. This includes fingerprint, credit and tax checks, and drug testing. In addition, continued employment is subject to a favorable adjudication of background investigation. Qualifications: Required Qualifications: Applicants must possess a J.D. Degree, be an active member of the bar (any U.S. jurisdiction), and have at least 1 year post-J.D. legal or other relevant experience. United States citizenship is required. Preferred Qualifications: Ideal candidates will have at least two years of experience in handling affirmative civil litigation or civil health care litigation cases. In addition, applicants should have a demonstrated capacity to function with minimal guidance in a highly demanding office and courtroom environment; must be willing and able to try jury cases in federal court and demonstrate the motivation and professionalism to become an accomplished trial attorney; should possess analytical ability to quickly identify and to clearly and accurately articulate critical issues in civil investigations or pending civil prosecutions; should be able to demonstrate superior oral and writing skills as well as strong legal research skills; should exhibit strong interpersonal skills, good judgment, the ability to work in a supportive and professional manner with the court, other attorneys, support staff, and client agencies; should also possess computer literacy skills to include experience in automated research, electronic court filing, electronic e-mail, and word processing systems. Salary: Assistant United States Attorneys' pay is administratively determined based, in part, on the number of years of professional attorney experience.
