    **Basic Purpose of Position : **


    The purpose of this position is to provide the full range of claims administration and investigation services for DRPA and PATCO (collectively “Authority”). This includes all lines of Authority insurance and areas of risk including but not limited to property, general liability, automobile liability, marine liability, casualty, short term/long-term disability, medical leave of absence and workers’ compensation, ADA, FMLA and paid parental leave programs. Another function of this position is to effectively manage and mitigate costs associated with losses resulting from damage to property or bodily injury to employees and customers using Authority facilities. This position also plays a key role in better understanding Authority losses and recommending steps to prevent future losses of a similar nature.

    Major Responsibilities and Duties


    DESCRIPTION OF TASK

    |

    Provide support and develop information useful for insurance policy renewals, self-insurance applications, and appropriate funding.

    |

    Assist in assessing risks and recommending program alternatives to reduce and mitigate losses.

    |

    Develop policies and procedures relating to the efficient administration of various claims management programs, including but not limited to return to work programs by ensuring that the Authority operates its claims management programs in conformance with applicable laws, acts, statutes, bond covenants and generally accepted industry practices and policies.

    |

    Responsible for managing and quality control of claims and making settlement recommendations to the Office of the General Counsel and other relevant staff.

    |

    Maintain extensive knowledge of all of the Authority facilities, including the condition and site-specific risks associated with same.

    |

    Establish consistent reporting and follow-up procedures for all claims involving customers, employees, and Authority equipment or property.

    |

    Maintain Authority database and conduct monthly reconciliation of vendor invoices and statements for all insurance and benefit programs. Ensures quality assurance and vendor compliance by conducting site review of claim files and procedural audits. Serves as Authority representative to various carriers, TPA’s and vendors to resolve billing, claim and administrative issues.

    Evaluate accident and claim trends to develop pro-active corrective measures. Identifies trends and makes recommendations to the appropriate party for improvement.

    Undertake appropriate investigations of recurring accidents to ascertain root cause and possible preventative measures that can be implemented.

    Investigate and preserve all records relating to employee and customer injury incidents to determine validity and liability. Monitors claims and where appropriate forwards to third party administrator.

    |

    Investigate and preserve all records of property damage incidents to determine validity and liability; identifies areas for third party recovery subrogation and recovery of monetary damages.

    Process self-insured damage claims timely.

    |

    Process ADA, FMLA, medical leave of absence, paid parental leave and short term/long term claims.

    |

    Monitor management of self-insurance programs by budgeting and review of payments to claimants and attorneys. Establish reserves with feedback from counsel and third-party administrator.

    |

    Review weekly and bi-weekly claim disbursement invoices for accuracy and submits for payment approval. Review invoices from outside attorney for services rendered. Review monthly Loss Run reports for accuracy and submit general liability reserve and workers’ compensation reserve information with appropriate allocation of departmental charges to Finance.

    Maintain, organize and prepare loss data for various reports and ensure proper communication of pertinent data with various levels of management and auditors.

    |

    Prepare litigated cases for the Authority’s defense and forwards those claims to house counsel. Assist legal counsel in the investigation and defense and assertion of claims; and in the coordination and assembly of responses to legal pleadings on behalf of the Authority.

    |

    Report on automobile incidents to appropriate insurance carriers to protect the interests of the Authority.

    Assist in gathering information in any type of alternative dispute resolution.

    |

    Provide training and education relating to compliance with work injuries, medical leaves, disabilities, accommodations, liabilities, and other work injury claims.

    |

    Recover monetary damages from others for property damage caused by them to Authority property. Results are measured in amounts of money recovered vs. apparent costs of loss less reduction for negligence of the Authority (if any).

    Perform other related duties as required and assigned by the General Counsel.

    EDUCATION/TRAINING

    Required:

    • High school diploma or general education degree (GED).
    • Minimum of five (5) years’ experience as a paralegal or legal secretary in a law firm, corporate risk management or legal department, or government agency, where the work is focused on worker’s compensation, property damage recovery, personal injury, general liability, and/or short term/long term disability.
    • Training in either claims management, tort litigation, general insurance practices, relevant laws, statutes and legislative acts, ADA program administration, FMLA program administration, PA & NJ worker’s compensation, or self-insured worker’s compensation program.
    • Experience and proficiency in relevant personal computer applications such as word processing and spreadsheet applications with an emphasis on spreadsheet applications.

    Preferred:

    • Bachelor’s degree in business administration, risk management, insurance or related field.
    • Work experience with bridge and transit operations.
