    We are looking to add an attorney to our legal team! We are seeking an attorney with at least 5 years of experience, either at a law firm or in-house, with intellectual property (trademarks, copyrights and patents), licensing of IP (both in-bound and out-bound), brand protection and consumer products. 

    The successful candidate for this position will work closely with our In-House Counsel and Director of Legal Affairs and play an important role in maintaining and growing our trademark and patent portfolio, protecting our brand and relationships, and growing our consumer products. We are looking for a candidate with a proactive, positive attitude, who has the desire and ability to collaborate effectively with team members and external business partners. A good fit for this position will also have keen attention to detail, be comfortable with and thrive in a fast-paced environment and possess the ability to be flexible and agile as we grow toward the future.

     ESSENTIAL FUNCTIONS:

    The responsibilities of this position will include, but will not necessarily be limited to, the following:

    • Oversee and monitor the company’s trademark and patent portfolios, including being responsible for clearance reviews, application of registrations and providing timely responses or taking actions necessary to maintain registration.   

    • Provide advice and recommendations to business executives regarding strategy, maintenance and audits of the company’s trademark and patent portfolios.

    • Draft, review and negotiate agreements between the company and its clients, business partners, and/or service providers in connection with various types of contracts, including Non-Disclosure Agreements, Professional Services Agreements, Licensing Agreements (both in-bound and out-bound), Merchandise Agreements, etc.

    • Review of merchandise for legal clearance and brand protection in connection with hard line and soft line consumer products.

    • Support the Director of Legal Affairs with frequent interface and management of domestic and international law firms.

    • Assist with the training and management of team members as needed.

    • Participate in special projects and legal research as assigned.

     

    REQUIREMENTS:

    ·        Must have in-depth knowledge of and experience with trademarks, including but not limited to:

    o U.S. and foreign trademark counseling, clearance, and prosecution experience, including review and analysis of clearance searches and preparing substantive responses to PTO office actions.

    o Preparing and filing applications to register trademarks with the USPTO, including international registration.

    o Monitoring trademarks, both domestic and international, including responding to action items and prosecution of matters.

    o Preparing and responding to cease and desist letters and handling other enforcement matters, including proceedings (oppositions and cancellations) and matters related to the use of trademarks on social media platforms.

    ·        Experience with copyright and patent law, including counseling, clearance reviews, filing applications for registration of patents and responding to actions involving patents.

    ·        Experience with review of merchandise for legal clearance, and compliance with applicable law.

    ·        Experience creating, reviewing and negotiating agreements with clients, business partners and/or service providers, regarding with IP licensing and merchandising agreements.

    ·        Experience or familiarity with creative review, advertising laws, publicity rights and social media.

    ·        Excellent written, verbal and interpersonal communications skills.

    ·        A positive attitude, with the ability to be flexible and pivot where unexpected challenges arise.

    ·        The ability to multi-task and handle a busy schedule in a fast-paced environment.

    ·        Be able to work independently, but also possess the ability to collaborate and communicate effectively with team members in a positive manner.

     

    REQUIRED JOB QUALIFICATIONS:

    • Must have a Juris Doctor degree and be admitted to a State Bar in at least one U.S. State.

    • Must have or be able to quickly acquire knowledge of company structure (mission, goals, and objectives), and policies and procedures.

    • Must possess a valid driver’s license.

    • Have the ability to travel, both domestically and internationally, if requested.

    • Must be authorized to work lawfully in the United States of America.
