We are open to considering both admitted attorneys (job title: eDiscovery Solutions Attorney) and non-attorneys with extensive eDiscovery project management or consulting experience (job title: eDiscovery Solutions Consultant) for this position.

    The eDiscovery Solutions Attorney/Consultant will receive a generous total compensation package. Bonuses are awarded in recognition of individual and firm performance.     As an eDiscovery Solutions Attorney/Consultant at Latham, you will apply your experience and advanced knowledge of eDiscovery strategies and best practices to provide advanced technical and workflow guidance to case teams, Practice Support Services (PSS) colleagues, and directly to strategic clients of the firm.  You will work alongside attorneys to understand client eDiscovery requirements, contribute to the overall case strategy, and develop operational plans to manage data, vendor relationships, and workflows, and work with other members of the PSS team to facilitate service requests. The Attorney/Consultant will act as a key point of contact for legal teams for eDiscovery including maintaining relationships with client eDiscovery personnel. You will insure that PSS team members and associates are trained on any client-specific work plans and that all processes are followed. The responsibilities of the Attorney/Consultant include:

    • Working with attorneys and client eDiscovery personnel to understand data sources, assisting with custodian interviews, preservation and data collection strategies.
    • Developing an operational plan for the matter for all phases of Discovery including collection, processing, review, and production.
    • Assisting legal teams to prepare for early meetings of counsel and other meet and confer sessions.
    • Understanding both the legal issues and technology issues of a case in order to assist with the preparation of instructional materials for the legal team.
    • Contributing to data tracking logs as appropriate, including documenting search strategies, reviewing workflow and other information related to the use of advanced technologies including technology-assisted review, prioritization recall rates and other related information.
    • Evaluating search terms to determine effectiveness of the search strategy. Advising case teams on effective search techniques.
    • Coordinating with vendors, and / or internal resources, to develop culling methodologies after the data has been collected.
    • Assisting legal teams with the selection of document review platforms, advanced technology options, electronic data filtering and culling options, review strategies, and quality control procedures. Preparing written documentation of the document review workflow and production criteria for all assigned matters.
    • Promoting adherence to all client expectations regarding electronic discovery procedures on assigned matters including the client’s preferred vendors, workflows and communications strategies, serving as a subject-matter expert for the case team on any written client guidelines.
    • Serving as the primary point of contact for the case teams on all assigned matters and responding to questions and requests related to any hosted eDiscovery data, engaging internal and external project managers to assist as necessary.
    • Implementing workflows for document review including the use of advanced technology and Technology Assisted Review (TAR) and ensuring all case team members, PSS staff, and contract attorneys are trained on the document review tools as well as the review workflow.
    • When appropriate, interacting with clients to obtain case-related information, discussing review strategies, documenting work plans, and ensuring internal and external client deadlines are met
    • Conferring with and advising attorneys on procedural and substantive eDiscovery-related issues.
    • Coordinating with the case team and client eDiscovery personnel to conduct post-project analysis to discover workflow challenges and collaboratively making recommendations regarding quality control processes to improve procedures for future projects.
    • Providing escalation support to PSS Project Managers in document search methodology and reviewing complex search criteria for accuracy and effectiveness.
    • Acting as a subject matter expert, for the Project Managers and other PSS staff, with advanced technology concepts and appropriate use. Providing training and / or consultations for Project Managers to support complex litigations and review workflows.
    • Keeping abreast of new technologies in electronic discovery. Participating in vendor demonstrations via web meeting or other presentation methods.
    • Handling sensitive matters with finesse and discretion.
    • Completing special projects as needed.
    • Promoting effective work practices, working as a team member, and showing respect for co-workers.
    • Acting within scope of authority in a manner consistent with firm guidelines, policies, and practices.

     

    As an Attorney/Consultant, you will be expected to apply your organizational and communication skills while displaying a positive, high-energy attitude. The successful Attorney/Consultant must have expert knowledge of the concepts, principles, management, and processing of Electronically Stored Information (ESI) as they relate to legal matters, including the use of various ESI management and review tools and application, as well as extensive knowledge of eDiscovery review platforms and related technologies such as Relativity, Axcelerate, Nuix, NexLP, Disco, and other industry leading tools. The ideal candidate will have a sound understanding of electronic discovery law and practice, knowledge of issues arising from foreign languages and character sets, ability to advise on forensic recovery, and examination of data and/or the ability to advise on preservation. The Attorney/Consultant will have excellent leadership skills, well-developed and professional interpersonal skills, strong communication skills, both written and verbal, and the ability to work effectively independently and in a team environment with a customer service focus.  

     

    A minimum of ten (10) years of litigation practice, paralegal, or practice support experience is required. A minimum of three (3) years of experience managing large electronic document reviews and production is preferred. Experience with litigation response and electronic discovery or records management issues is desired. A bachelor’s degree is required for an eDiscovery Solutions Consultant. A JD degree from an ABA-accredited law school and admission to at least one US State Bar is required for an eDiscovery Solutions Attorney.
