The Court of Appeals is comprised of three judges appointed by the Community Council for four (4) year terms. Judges are eligible for reappointment at the end of their term. The Court of Appeals hears and decides appeals from the Community Court including appeals from final judgments in civil and criminal cases, appeals pursuant to authority in the Childrens Code, appeals from administrat ive bodies and original matters seeking extraordinary or post-conviction relief. ESSENTIAL FUNCTIONS: Make decisions in appeals filed in the Court of Appeals in a timely manner; Review briefs and motions submitted in appeal proceedings; Appear for when necessary or appropriate and conduct oral argument and other hearings in appellate cases; Conduct appropriate legal research necessary to make decisions; Draft written decisions and orders; Participate in conference with other judges of the Court of Appeals; Apply the Constitution and Bylaws of the Gila River Indian Community (1960), the Gila River Indian Community Code and Court of Appeals precedent and, where applicable other laws in deciding cases. Perform other related duties as assigned. REQUIRED KNOWLEDGE, SKILL AND ABILITY: Knowledge of federal Indian law, including jurisdictional principles and sovereign immunity; Knowledge of tribal laws, ordinances, rules, regulations and procedures, especially those relating to the Gila River Indian Community; Considerable knowledge of legal practices/standards, and court procedures; Knowledge of or an appreciation for Community customs and traditions; Must be skilled in research, fact finding, and writing; Ability to communicate effectively, clearly and concisely, both orally and in writing; ------------ Ability to establish and maintain a high level of discipline, order, and decorum in court. Ability to make legal judgments in an independent, responsible, and impartial manner; Ability to establish and maintain effective working relationships with attorney and non-attorney court practitioners, employees, other judicial entities or courts, Community Officials and the general public; Ability to perform all physical requirements of the position; agree to maintain a Drug-free workplace. REQUIRED EXPERIENCE AND TRAINING: Juris Doctorate degree from an ABA-accredited law school and admitted to practice of law and in good standing in the bar of any state required; a minimum of three (3) years recent full-time experience in active practice of law; prior practice in the area of Federal Indian Law plus two (2) years of demonstrated recent substantial experience in working with tribal governments with judicial experience especially in appellate role and knowledge of Arizona law preferred. ADDITONAL REQUIRMENTS: Must provide a letter from the bar association to identify good standing with that particular States Bar Association. Must provide a letter certify what type of judicial position from tribal courts admitted to practice in if candidate practiced law in a tribal court during the course of their professional career or served in a judicial capacity. Must be of good moral character and integrity; capable of carrying out duties of office. Must provide submit two (2) writing samples of your choice no more than ten (10) pages. Prospective employees shall not possess the following background: 1. Any felony convictions in any jurisdiction 2. Any misdemeanor conviction in any jurisdiction within the last five (5) years. 3. Any misdemeanor conviction in any jurisdiction within the last seven (7) years that involved a dishonest act or false statement, e.g., fraud, theft, perjury; or a crime against a vulnerable individual. Subject to review as to conflicts of interest and shall abide by the Code of Ethics for Judicial Employees. No pending criminal charges, conviction(s) for any felony or crime, including convictions involving moral turpitude and must not have any misdemeanor convictions in any jurisdiction within a five (5) consecutive year period prior to the appointment date of this position. All individuals seeking this position will be subject to a background check that requires a satisfactory criminal history check to be considered for this position. Any Tribal employee appointed to this position must resign from their position with the Gila River Indian Community and must be in an inactive status prior to the effective start date for this position.
