    Job Description

    AECOM Hunt is seeking a Regulatory Compliance Analyst III to join our Hunt Construction group. This position provides a flexible remote work arrangement and will be supporting the Indianapolis, Indiana office location.

    Job responsibilities include, but are not limited to:

    Works with prime and subcontractors to ensure compliance with prevailing wage requirements. Keeps abreast of Federal and State laws and other relevant information including Davis-Bacon and Related Act (DBRA), Federal and State Rate tables or wage determinations, etc. Ensures complete understanding and full administration of “Bona-Fide” fringe benefits under DBRA and state prevailing wage law requirements. Reviews certified payrolls and works actively with subs and tiers to correct issues and appropriately addresses delinquent certified payrolls. Conducts wage rate and classification interviews. Visits job sites to ensure appropriate labor and other related posted information. Has a working knowledge of Union language (CBA’s), Union Rate Sheets, Apprentice to Journeyman ratios and or Project Labor Agreements (PLA’s). Performs other duties of a similar nature as may be required.

    Essential Functions

    Ensures that hourly laborer and mechanics are aware of the Federal or State Prevailing wage and all required posting are available for review in an assessable location at any time during working hours.

    Keeps abreast with all the applicable laws, federal, state and local. Maintains updated knowledge regarding wage and hour, Fair Labor Standards Act (FLSA), Davis-Bacon and Related Act (DBRA), and other applicable laws. Keeps abreast with apprenticeship laws and relative guidelines. Ensures apprenticeships don’t exceed ratio permitted in wage and hour schedule. Confirms all appropriate apprenticeship registration with the State Apprenticeship Councils. Ensures all required Apprenticeship documentation is received and uploaded for future audits.

    Ensures accurate quality assurance of contractor and subcontractors certified payroll records. Ensures certified payrolls reflect necessary information including signed certification, reflect the use of Bona Fide plans or not, correct payroll numbers and dates, fringe benefit payments (either to a bona fide plan or in cash), etc. Reviews issued subcontracts for Prevailing Wage language.

    Works in LCP Tracker to setup and maintain contractor submitted records along with documentation on corrections, retro pays and other required documentation as per law or contract. Obtains and maintains this documentation to make available for public inspection and reference. Obtains all pertinent information and documentation from contractors and tiers required by the wage laws through to the end of the project.

    Supplies contractors and tiers with any changes in Prevailing Wage Rates and other related information.

    Follows established procedures to monitor compliance by contractors and tiers for all assigned projects. Visits project sites to verify posting requirements and job classifications. Reviews certified payroll reports to ensure they are submitted in a timely fashion and all necessary information is obtained. Compares rates and fringes reported to rates in prevailing wage schedule. Requires affidavit of compliance from each contractor and subcontractor upon project completion when required by law.

    Works with contractors to correct any non-compliance issues. Reports to labor compliance manager or coordinator any non-compliance issues contractors are not working to correct so a determination of held funds may be appropriate.

    Reports to compliance manager or coordinator for instruction prior to conducting site audits in response to personal claims of non-compliance with prevailing wage rates on the part of contractors or tiers. Conducts interviews with contractor employees, collects witness statements when necessary, observes work being performed to validate classifications. Conducts job studies of work being performed by claimants(s). Exercises judgement when matching documented activities to the most appropriate work group/title (work classifications) for which a prevailing wage rate exists. Analyzes payroll documents to determine pay rates provided employees of project contractors; matches rates being paid with work being performed and amount of time it was performed. Determines variance (if any) from prevailing wage rate(s) in effect for work activities. Upon determining that inappropriate rate(s) are being paid, calculates appropriate back wages and benefits to be paid to affected employees; determines liquidated damages to be assessed against the contractor by following guidelines specified in the contract or by state for federal laws and forwards to compliance manager for review and recommended course of action.

    Performs other duties of a similar nature as may be required. Helps contractors submit conformance requests. Receives and distributes general wage decisions from the U.S. Department of Labor. Helps with training when requested. Reports any audit request to the Compliance Coordinator and assists with requested documentation.

  • Qualifications

    Qualifications

    Minimum Requirement:
    • BA/BS + 4 years of relevant compliance experience or AA/AS + 6 years of relevant experience or HS/GED + 8 years of relevant experience
    • Previous experience supporting accounting and/or payroll functions
    • Strong analytical and mathematic skills to support detail auditing requirements
    • Requires 25% + travel
    • Valid Driver’s US License for the use of a motor vehicle to support required travel to complete project tasks assignments and scope of work.

    Preferred Requirement:
    • BA/BS in accounting or finance, or similar discipline
    • Previous construction industry experience
    • Understanding of payroll deductions, fringe benefits and their calculations
    • Excellent communication skills
    • Previous experience working with the Department of Labor (DOL), subcontractors and unions
    • Knowledge of LCP tracker software and CMIC highly desired
