OUR OPPORTUNITY:
The PEO Risk and Compliance Analyst is responsible for researching, tracking and meeting all PEO corporate compliance obligations for the organization, and for managing Aspen’s workers comp program.
WHAT YOU'LL DO:
- Create, modify, update, and implement the company’s compliance policies. Support internal departments on all compliance related matters. Liaise with other departmental heads to ensure that all business operations are in line with compliance/regulatory policies.
- Design ongoing compliance training programs for employees of the business.
- Maintain filings calendar and coordinate with team to ensure compliance with all legally required filings (such as forms 5500, EEO-1, CA Pay Data, M-1, HIPAA notices, 1099’s, non-discrimination testing, etc.).
- Manage SOPs, compliance calendars, and related materials and guides.
- PEO Corporate Compliance Program:
- Retain proper record keeping of corporate books including articles, operating agreements, bylaws, board minutes, etc.
- Responsible for regulatory compliance including corporate registrations, PEO licensing and other registrations. Ensure compliance with ESAC filings and requirements. Lead CPEO certification process as well as ongoing license requirements.
- Responsible for maintenance of internal corporate insurance coverages including EPLI
- Create, maintain, and implement control systems, policies and procedures related to corporate compliance.
- Maintain compliance with Federal, State and Local employment laws and regulations. Work cross-functionally when changes to operations are necessary to comply with new laws and regulations.
- Responsible for CSA template creation, updates and maintenance. Retain master CSA tracking and files. Work with clients and counsel on updates and amendments. Maintain master corporate contract listing and assist in vendor contract review & monitoring.
- Benefits Compliance
- Manage processes in partnership with benefits team to ensure accurate and effective compliance administration and identify opportunities for efficiencies and risk reduction.
- Consistent review of regulatory compliance, including but not limited to ERISA, ACA, HIPAA, FMLA, COBRA and similar federal, state and local regulations.
- Workers Compensation
- Work closely with the workers’ compensation carrier and Aspen’s internal IT Department to maintain accurate policy data in the system for each Aspen client. Update the workers’ compensation policy issuance file on a weekly basis to identify new and termed clients to the insurance carrier.
- Act as liaison between Aspen and the broker/carrier for matters relating to workers’ compensation exposures and appropriate coverage for those exposures. Play integral part in the yearly workers’ compensation policy renewal program.
- Conduct extensive research to resolve workers’ compensation penalties assessed by state agencies to Aspen clients. Act as back-up to maintain & submit the workers’ compensation quarterly compliance of current and former clients in the state of Washington and Experience Modification Ratings. Manage the data reporting process for client experience modification calculation as dictated by various state regulations.
- Submit quarterly reporting for E.S.A.C. (Employer Services Assurance Corporation). Manage monthly/yearly payments made to experience modification rating agencies (NCCI, WCIRB, Compline, NYCIRB and Vertafore).
- Create and maintain the policy and procedures for Risk Operations Department. Act as a workers’ compensation resource to other internal departments and field-based personnel.
WHAT YOU'LL BRING:
- Bachelor’s degree, in business management, legal studies, finance, business administration or similar field.
- 5-year minimum experience in governance/compliance- prior PEO experience preferred.
- Good grasp of industry processes and existing business regulations.
- Ability to make recommendations to effectively resolve problems or issues by using judgment that is consistent with the standards, practices, policies, procedures and federal, state, and local regulations.
- Ability to conduct extensive research and analyze various different types of data.
- Strong sense of business ethics including the ability to appropriately handle confidential information.
