  • Responsibilities

     

    POSITION SUMMARY: Under the close supervision of a Supervising Attorney within the Special Education Unit of the Office of Legal Services, with some latitude for independent judgment and decision-making, the Special Education Unit (SEU) Attorney Interne performs legal work related to IDEA claims filed by parents or the DOE regarding services provided to students classified with, or suspected of having a disability. Performs related work.

     

    REPORTS TO: Special Education Unit Team Leader

     

    DIRECT REPORTS: N/A

     

    KEY RELATIONSHIPS: The Special Education Unit Attorney Interne works closely with the Special Education staff, including the Special Education Office, Committees on Special Education, the Office of School Support, the Public Schools, and other offices that directly support the Public Schools and the staff in the Office of Legal Services.

     

    RESPONSIBILITIES

     

    • Perform legal research assigned by Team Leaders, including review of legal cases, opinions, decisions, and abstract salient points and references.
    • Assist in preparing legal arguments and documents, such as memoranda, motions, pleadings, briefs, subpoenas, etc.
    • Review transcripts and exhibits from administrative proceedings to assist Agency Attorneys.
    • May attend impartial hearings alongside Agency Attorneys.
    • Work with Agency Attorneys on different phases of settlement process including:
      • investigating claims filed by parents, including interviewing potential witnesses, conferring with other attorneys, consulting with specialists, etc.;
      • review of settlement documents submitted by the Parent;
      • researching state and federal case law;
      • drafting memoranda for submission to the New York City Comptroller’s Office for settlement authority for proposed settlement;
      • coordinating and monitoring the implementation of stipulated agreements; and
      • performing research in connection with claims for attorney’s fees submitted by opposing counsel.

     

    QUALIFICATION REQUIREMENTS

     

    MINIMUM

     

    Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.

     

    SPECIAL NOTE:

     

    This class of positions has a maximum two year term.

     

    PREFERRED

     

    • Excellent communication and interpersonal skills.
    • Ability to understand provisions of applicable laws and regulations.
    • Ability to write clearly and concisely.
    • Efficient legal research skills.
    • Internal candidates preferred.

     

    SALARY: $70,042+

    QUALIFICATIONS:

     

    To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. The requirements listed below are representative of the knowledge, skill and/or ability required.

     

    • 6 months applicable work experiences; or one year quality or manufacturing related experience.
    • The position requires the ability to add, subtract, multiply and divide in all units of measure, using whole numbers, common fractions and decimals and the ability to compute rate, ratio and percent.
    • The position requires the ability to apply common sense understanding to carry out instructions furnished in written, oral or diagram form and the ability to deal with problems involving several concrete variables in standardized situations.
    • Able to stand as needed for the position.
    • Able to lift 50 pounds on an occasional basis.
    • Able to work weekend and overtime hours as needed.
