    Job Description

    The Department of Labor and Industry is seeking a self-motivated individual to serve as Staff Attorney, Senior in the agency’s Division of Legal Support. This position serves as full time litigation lead counsel in Virginia Occupational Safety and Health (VOSH) contested cases in circuit courts, when appointed as a Special Assistant Commonwealth’s Attorney (including responsibility for occupational health cases, asbestos/lead licensing, asbestos National Emission Standards for Hazardous Air Pollutants (NESHAPS) and Boiler Safety cases).
    This position also researches and analyzes legal issues upon request from agency staff to facilitate compliance efforts under applicable laws, regulations, and standards, presents findings and recommendations to agency leadership resulting from the legal research and analysis, and handles more complex cases. In addition, this position provides legal and technical support in the development of standards, regulatory rulemaking, policy formulation, and legislative proposals. This position is partially funded from Federal Grant Sources and continuation is dependent upon the availability of funds.

    Minimum Qualifications:

    • Knowledge of Virginia Rules of Civil Procedure and the Virginia Administrative Process Act.
    • Excellent verbal and written communication skills.
    • A Juris Doctor degree from an accredited law school.
    • An active member of the Virginia State Bar.

    Additional Considerations:

    • Litigation experience.
    • Knowledge of Federal and State laws governing Apprenticeships, Labor, and Occupational Safety and Health, as well as the ability to conduct research and analysis.
    • Experience in a similar position in government or private industry.
    • Verifiable fluency in speaking, reading, and writing Spanish.

    Special Requirements:
    • Possession of a valid driver’s license or ability to obtain a valid driver’s license.
    • Ability to occasionally travel overnight.
    • Ability to perform moderate physical activity that includes, but is not limited to, climbing stairs and ladders, bending, walking up and down inclines, occasionally lifting and carrying loads up to 30 pounds, etc.
    • The selected candidate must successfully:
    o complete a criminal background investigation.
    o serve a 12-month probationary period effective from the date of employment if beginning employment as an original hire or re-employment.

    The starting salary range is $65,000 - $90,000 annually, plus the State’s benefits package. Please note that salary is only negotiable within the advertised salary range. Interview candidates may be required to demonstrate the skills and abilities necessary for satisfactory performance of the work.
