    Job Description

    Our rapidly growing company is excited to expand its legal team by hiring its second attorney.  As the second attorney with the company, this position provides significant experience and growth opportunities as well as the opportunity to develop this role further based on your areas of expertise and interests.  Under the leadership and mentorship of the General Counsel, the Assistant General Counsel will support core cross functional business operations across the 15 states where the company operates and in the day-to-day management of the company’s diverse legal affairs.  This Assistant General Counsel position will focus on managing and advising on a broad range of litigation and disputes matters as well as providing support in other areas managed by the Legal Department, such as healthcare regulatory, privacy, compliance and contract matters.  The Assistant General Counsel will work directly with the company’s General Counsel and will have interactions with operational leaders, functional departments and outside counsel in this role. 

    RESPONSIBILITIES

    • Work closely with the General Counsel and Legal Department team members to provide high quality legal work for the company, our facilities and staff members.
    • Proactively manage litigation and potential litigation matters, including the following:
      • Work with outside counsel to develop case strategy, investigation plan and discovery/e-discovery plan. 
      • Managed the company’s litigation hold process and preservation of evidence.
      • Review court filings and provide feedback and oversight.
      • Work with the company’s insurance broker on reporting litigation and potential litigation risks as appropriate under the company’s insurance policies.
      • Focus on limiting the company’s risks related to litigation and potential litigation.
    • Provide legal guidance and counseling regarding healthcare laws and regulatory issues, including research projects on the impact of specific laws/regulations on the company’s current business lines and planned business lines, collaboration with business leadership and functional departments on managing the impacts to their operations. 
    • Support the contract review and negotiation process especially in connection with drafting and negotiating contracts with physicians, clinicians and other providers in compliance with applicable healthcare regulatory issues.
    • Support the privacy officer in connection with ongoing compliance with HIPAA, 42 CFR Part 2 and applicable state privacy laws. 
    • Assist compliance partners as they implement the compliance program, including assisting with the management of compliance matters that present legal or regulatory risk to the company.
    • Work collaboratively with the members of the Legal Department, which may include developing additional skills of the team members in your areas of expertise.
  • Qualifications

    Qualifications

    • J.D. from an ABA accredited law school and admission in good standing to a State Bar (CA preferred),

    • Minimum of 4-7 years of legal experience combined law firm and in-house with healthcare experience.

    • Significant litigation experience and demonstrated experience in shaping and executing litigation and investigation strategies.

    • Demonstrated qualities consistent with the Legal Department’s operating style based on mutual respect, teamwork focus, ethical behavior and creative problem solving to act as a respected internal resource for our facilities and staff members

    • Highly developed interpersonal and communication skills, sound judgment and the ability to establish personal relationships and rapport internally and externally.

    • Creative problem solver and practical business partner with a solutions-focused approach.

    • Strong research and analytical skills.

    • Ability to manage several matters at one time in a fast-paced environment.

    • Preference for candidates who are able to work on-site in the company’s headquarters in Orange County, CA.
