    Duties & Responsibilities

    · Manage a team of labor compliance specialists providing organizing and leadership skills.

    · Perform worker complaint investigations and audits filed with the Department of Industrial Relations (DIR) in accordance with State and Federal published labor standards guidance.

    · Investigate and audit contractor compliance with Project Labor Agreement requirements.

    · Monitor subcontractor compliance with State of California Labor Laws and ensure timely submittal of certified payroll reports and other required form submittals.

    · Conduct worker interview site visits and correlate with Daily Reports, timesheets, Time & Material Tickets, and Certified Payroll to validate worker hours to Time & Material Tickets, invoices, and Change Orders.

    · Audit for proper trade classification when compared to work summaries, project journals, Sign-In Sheets, Timesheets, and Daily Construction Reports.

    · Assist in the resolution of prevailing wage violations or potential violations discovered through compliance verification, worker complaints, project team audit requests or Owner discovered discrepancies.

    · Ensure timely submittal of certified payroll reports by all contractors at all tiers into the Division of Labor Standards Enforcement reporting web page.

    · Audit certified payroll reported wage rates and fringe benefit contributions

    · Validate the accuracy of subcontractor certified payroll.

    · Ensure apprenticeship compliance of properly registered apprentices including but not limited to apprentice requests, DAS142 submittals, and apprentice to journeyman ratios.

    · Conduct Full (100%) audit of subcontractor certified payroll reports when deemed necessary due to potential high dollar exposure to the Client when subcontractor displays an unwillingness to comply with project Labor Compliance requirements.

    · Calculate back wages and potential penalties upon prevailing wage violations for underpayment occurrences discovered in internal audits. Issue delinquency notices to subcontractors for violations and infractions. Request corrective action be taken. Recommend withholding of contractor's funds from progress payments for noncompliance. Verify wages and prepare wage underpayment reports as required by awarding agency.

    · Approve authorization to release retention for primary subcontractors. Collect safe harbor affidavits upon progress and final payments.

    · Verify payment of training fund payments and/or fringe benefit contributions.

    · Communicate compliance status (underpayment reports) to Client via monthly subcontractor status reporting. Maintain working relationships with subcontractors, compliance enforcement agencies, and project team members.

    · Demonstrate continuous effort to improve operations, streamline processes and work amicably to provide quality customer service.

    · Conduct Final Review and Close-out all contractors at all tiers. Ensure files are organized and contain complete reporting and correspondence for record keeping purposes and potential audits conducted prior to statute of limitations.

    · Ensure all certified payroll reports and required forms have been collected.

    · Ensure collection of safe harbor affidavits.

    · Approve final authorization to release retention for primary subcontractors.

    · Provide all working files including but not limited to certified payroll reports, email communication, correspondence letters, contract requirement research, audit documents, and other related documents to Client.

    · Prepare weekly, quarterly, semi-annual, and special reports as defined by supervisor.

    · Draft Labor Compliance Packet for pre-construction conferences and subcontractor Orientation Meetings.

    · Assist in managing grievances filed by unions.

    · Assist in mediating arbitrations between contractors and unions when project labor agreements

    · Perform compliance investigations and audits in accordance with the Department of Industrial Relations (DIR), the U.S. Department of Labor for Davis-Bacon and Related Acts Violations

    · Prepare documentation necessary to support the Request for Forfeiture process with the State of California Division of Labor Standards Enforcement, and U.S. Department of Labor Wage and Hour Division

    · Monitor, track, and report Disadvantaged Business Enterprise and Equal Employment Opportunity compliance for federally funded projects.

    Qualifications:

    Required Experience:

    · 15+ years’ experience in labor compliance management roles and positions

    · Deep understanding of Department of Industrial Relations (DIR) labor compliance laws and regulations and the U.S. Department of Labor Davis-Bacon and Related Acts

    · Experience with Project Labor Agreements

    · Experience monitoring, tracking, and reporting of DBE and EEO compliance for federally funded projects

    · Experience utilizing compliance software programs including LCPtracker, City of Los Angeles labor compliance software, and B2Gnow.

    · Proficient with Microsoft Excel

    · Familiarity with Microsoft Office Suite
