Business Immigration Attorney
We are seeking a knowledgeable and detail-oriented Business Immigration Attorney to join our Berkeley, California-based law office. This role focuses on employment-based immigration matters, assisting businesses, startups, investors, and professionals with navigating complex immigration processes. The ideal candidate has expertise in employment-based visas, PERM labor certifications, and corporate compliance. This is a full-time, in-office position requiring collaboration with clients, colleagues, and corporate stakeholders.
Key Responsibilities:
Counsel businesses, startups, and professionals on employment-based immigration matters, including H-1B, L-1, TN, E-2, and O-1 visa petitions.
Prepare and manage PERM labor certification applications and employment-based green card filings (EB-2, EB-3, and National Interest Waivers).
Assist investors and entrepreneurs with EB-5 Immigrant Investor Program applications and E-2 Treaty Investor visas.
Advise employers on I-9 compliance, worksite enforcement, and immigration-related labor law considerations.
Prepare responses to Requests for Evidence (RFEs), appeals, and motions before USCIS and other agencies.
Stay up to date on federal immigration regulations and changes impacting employment-based immigration.
Represent clients in administrative interviews before USCIS and in consular processing matters.
Conduct legal research and draft legal memoranda, petitions, and compliance documentation.
Provide guidance on immigration strategies for corporate clients, including multinational companies, startups, and non-profit organizations.
Essential Qualifications:
Juris Doctor (J.D.) degree from an accredited law school and a member in good standing of any state bar (California strongly preferred or ability to waive in).
Minimum of 2+ years of experience in business immigration law.
Strong legal research, writing, and case management skills.
Familiarity with PERM labor certification, employment-based visa sponsorship, and corporate immigration compliance.
Ability to manage a high-volume caseload while maintaining excellent client communication.
Experience working with corporate clients, including multinational companies and startups, is a plus.
Preferred Qualifications:
Fluency in Spanish or another language commonly spoken in immigrant communities is strongly preferred.
Experience with EB-5 Investor Program applications and E-2 visas.
Knowledge of crimmigration (intersection of criminal and immigration law) as it pertains to employment-based cases.
Familiarity with California labor laws affecting immigrant workers.
Prior experience advising clients on global mobility and business expansion strategies.
Salary, Benefits, and Work Location: The salary for this position is at least $135,000 per year, commensurate with experience and qualifications.
