Litigation Associate
Job Description
Our plaintiff's firm seeks a mid-level to senior associate to independently manage complex nursing home wrongful death cases from inception through trial. This position offers exceptional professional development opportunities in high-stakes litigation while serving families seeking accountability for preventable deaths in skilled nursing facilities.
Position Overview
As an independent case manager, you will handle all aspects of litigation including discovery, motion practice, depositions, court appearances, and trial work. What sets our firm apart is that we actually try cases—providing you with invaluable courtroom experience that many litigators never receive. This role provides comprehensive exposure to both medical and financial aspects of institutional negligence cases, offering unique skill development in forensic medical record analysis, regulatory compliance, and corporate structure investigation.
Core Responsibilities
You will manage your own caseload with full responsibility for case strategy and execution. This includes taking and defending depositions of fact witnesses, corporate representatives, and medical experts. You'll regularly appear in court to argue substantive motions and manage hearing schedules across multiple jurisdictions. Unlike firms that settle everything at mediation, we prepare every case for trial—and you'll participate as first or second chair in jury trials involving complex medical evidence and corporate liability theories.
The position offers distinctive professional development through specialized skills rarely found in general litigation practice. You'll become proficient in analyzing electronic medical records to identify patterns of neglect, reviewing staffing data and payroll records to establish systemic understaffing, and interpreting Medicare/Medicaid cost reports to trace financial priorities. You'll learn to work with industry-specific metrics like PPD calculations and PBJ data analysis, skills that are increasingly valuable in healthcare litigation.
Professional Growth Opportunities
This role provides extensive experience with complex discovery, including managing large document productions and developing discovery strategies for corporate structures designed to limit liability. You'll draft and argue dispositive motions, work with medical and industry experts, and develop trial themes that connect corporate decisions to resident outcomes. The intersection of healthcare, regulatory law, and corporate accountability offers a sophisticated practice area with growing demand.
Most importantly, you'll gain actual trial experience. While many associates spend years in litigation without ever selecting a jury, you'll participate in voir dire, opening statements, direct and cross examinations, and closing arguments. This hands-on courtroom experience, combined with comprehensive case management responsibilities, accelerates professional development far beyond typical litigation positions.
Associates also gain valuable experience in case valuation, settlement negotiation, and mediation advocacy. You'll develop expertise in federal and state nursing home regulations, healthcare finance, and quality assurance standards. The ability to analyze and present complex medical and financial data—from wound progression documentation to staffing pattern analysis—provides transferable skills valuable throughout healthcare litigation.
Qualifications
We seek candidates with 3-7 years of litigation experience and demonstrated ability to manage cases independently. Prior experience in medical malpractice, personal injury, or healthcare litigation is preferred but not required for candidates who demonstrate strong analytical skills and litigation capability. Trial experience is not necessary—we will train you and provide opportunities to develop these critical skills.
Essential qualities include excellent legal writing, strong oral advocacy skills, and the ability to synthesize complex medical and financial records into clear, compelling narratives. You should be detail-oriented yet able to see larger patterns across documentary evidence. Most importantly, you should be eager to develop trial skills and comfortable with the responsibility of representing families in the courtroom.
Compensation and Benefits
Salary range: $100,000 - $175,000, commensurate with experience and demonstrated litigation skills. We offer comprehensive benefits and a collegial environment focused on professional excellence. The firm supports continuing legal education and professional development opportunities specific to healthcare litigation and trial advocacy.
Application Process
Interested candidates should submit a resume, cover letter addressing your litigation experience and interest in healthcare accountability, and a writing sample demonstrating your advocacy skills. Please include specific examples of your case management experience and any relevant motion practice or deposition work.
