    THIS TITLE IS IN A CIVIL SERVICE COMPETITIVE CLASS THAT IS SUBJECT TO EXAMINATION.  POSITION IS ONLY OPEN TO APPLICANTS WHO ARE PERMANENT AS ADMINISTRATIVE STAFF ANALYST, OR PERMANENT IN AN EQUIVALENT TITLE THAT IS ELIGIBLE FOR 6.1.9 TO ADMINISTRATIVE STAFF ANALYST.

    POSITION SUMMARY:  In alignment with the Mayor’s Equity and Excellence agenda, the Division of School Planning and Development oversees a broad range of DOE offices and functional areas including the Offices of Space Management, District Planning, School Design and Charter Partnerships, Nonpublic Schools and Impartial Hearing. The Division also coordinates interagency work with the School Construction Authority and Educational Construction Fund.

     

    The Executive Director of the Impartial Hearing Office supports all activities attending the administration of the impartial hearing process for parents seeking relief pursuant to Individuals with Disabilities Education Act (IDEA) and serves as an advisor to the Senior Executive Director on policy decisions.  

     

    This includes supporting all pre- and post-hearing activities so that determinations regarding students services are made in a timely fashion and that it is done with confidentiality relative to the documentation of all filings and proceedings and to assure the Department of Education’s compliance with federal and state laws and regulations regarding Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act. Performs related work.

     

    REPORTS TO: Senior Executive Director, IHO

     

    DIRECT REPORTS: Director of Hearing Administration, Mediation Liaisons

     

    KEY RELATIONSHIPS:  Supports the Senior Executive Director in serving as a liaison to the New York State Education Department (NYSED), City Hall, Corporation Counsel of the City of New York in litigation involving the Department of Education or other proceedings pertaining to the education of children with disabilities to which the Department may be a party. Confers with Counsel to the Department of Education on legal matters in a highly confidential and ongoing relationship. Maintains a close working relationship with school personnel, parents, community groups and child-related agencies.

     

    RESPONSIBILITIES

     

    • In coordination with families and community organizations, develops the DOE’s strategy related to supporting families in accessing mediation services.
    • Provides clear communications to families across the City regarding their legal rights to due process and the use of mediation, when applicable.
    • Responsible for the preparation and coordination of the requisite notices and documentation to assure full due process rights for students with disabilities.
    • Advises Senior Executive Director in formulating appropriate policy, both legal and administrative, relative to issues affecting due process and education of children with disabilities.
    • Acts as a continuing resource for Mediation Liaisons, Director of Hearing Administration and Impartial Hearing Officers concerning changes in federal and state laws and regulations, decisions of federal and state courts and State Review Officer decisions. Provides information and material, as appropriate, to hearing officers during hearings.
    • Responsible for the recruitment, training and orientation of surrogate parents appointed by impartial hearing officers to assure the protection of children with disabilities.
    • Serves as a liaison to Department of Education offices in order to assist in the delivery of services recommended by the Committees on Special Education or as ordered by a hearing officer, the State Review Officer or a court; periodically reviews the identification-evaluation-placement status of special children as it pertains to and defines the due process guarantor role and the function of the Impartial Hearing Office.
    • Expedites the resolution of conflicts for parents who request assistance from the Impartial Hearing Office; refers parents to appropriate Department of Education personnel where it appears that such services will avoid the need for an impartial hearing.
    • Supports reporting to NYSED regarding the DOE’s Special Education Compliance Assurance Plan for due process.
    • Responsible for supporting the Senior Executive Director in developing public-facing analyses and reports for elected officials, press outlets, families and communities.

     

    QUALIFICATION REQUIREMENTS:

     

    MINIMUM

     

    1. A master's degree from an accredited college in economics, finance, accounting, business or public administration, human resources management, management science, operations research, organizational behavior, industrial psychology, statistics, personnel administration, labor relations, psychology, sociology, human resources development, political science, urban studies or a closely related field, and two years of satisfactory full-time professional experience in one or a combination of the following: working with the budget of a large public or private concern in budget administration, accounting, economic or financial administration, or fiscal or economic research; in management or methods analysis, operations research, organizational research or program evaluation; in personnel or public administration, recruitment, position classification, personnel relations, employee benefits, staff development, employment program planning/administration, labor market research, economic planning, social services program planning/evaluation, or fiscal management; or in a related area. 18 months of this experience must have been in an executive, managerial, administrative or supervisory capacity. Supervision must have included supervising staff performing professional work in the areas described above; or
    2. A baccalaureate degree from an accredited college and four years of professional experience in the areas described in "1" above, including the 18 months of executive, managerial, administrative or supervisory experience, as described in "1" above.

     

    PREFERRED

     

    • Possession of a Law degree from an accredited university.
    • Experience dealing with child advocacy issues.
    • Experience in Special Education Mediation.
    • Knowledge of Individuals with Disabilities Education Act.
    • Internal applicants preferred.

     

     SALARY: $129,014+

     

    (Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not make less than their current salary.)

    QUALIFICATIONS:

    • Bachelor’s Degree or an equivalent combination of education and experience.
    • Knowledge of Medicare, CMS regulations and other government entitlement products.
    • Excellent written and oral communication skills.
    • Experience with sales lead management system preferred.
    • Must possess a valid and appropriate state accident and health license at time of hire or within the first 60 days in the position.
