    Job Description

    TCS Education System has an opening for a newly created LEGAL COUNSEL position within the OFFICE OF THE GENERAL COUNSEL (“OGC”).

    Reporting to the General Counsel, the Legal Counsel will support the growing legal, compliance and regulatory needs related to clinical and healthcare matters of the TCS Education System office and its affiliated institutions. This is a unique opportunity to provide impact on a growing team and help define this new position. The Legal Counsel should be a motivated, self-starter with a proven track record of success in negotiating, drafting, and reviewing various types of agreements relevant to higher education.

     

    RESPONSIBILITIES INCLUDE, BUT ARE NOT LIMITED TO:

    • Regularly draft, review, revise negotiate, and consult on varied agreements related to clinical affiliations, internships and practicums, in addition to academic partnerships and memorandums of understanding.
    • Draft/redline contracts in a timely fashion that accurately reflect the business transaction while minimizing risk to the client.
    • Create and facilitate best practices to ensure compliance with obligations under affiliation agreements including developing and delivering trainings.
    • Support, educate and assist in training faculty with respect to negotiating contracts and understanding legal obligations and risks.
    • Provide consultation related to site or student concerns.
    • Counsel clients on issues related to compliance with healthcare regulations and best practices including but not limited to telehealth, HIPAA, and insurance requirements.
    • Support risk-aware culture and ensure effective risk management practices are upheld.
    • Complete other related duties as assigned by General Counsel.

     

     

    POSITION REQUIREMENTS:

    • Excellent written/verbal communication skills and interpersonal skills.
    • Ability to build strong business relationships, maintain the highest level of integrity, and be adaptable to various communication styles, situations, and personalities.
    • Familiarity with clinical affiliation internship and practicum and related agreements, preferably in the higher education space.
    • Experience with FERPA, HIPAA and the intersection between higher education and healthcare.
    • Strong understanding of contract terms and conditions.
    • Ability to balance legal business/organization/institution risks with business objectives.
    • Experience creating and delivering presentations and trainings.
    • Propensity for attention to detail, accuracy, organization, efficiency, adaptability, and prioritizing/shifting work responsibilities.
    • Capacity to work independently and within a team framework to plan and coordinate multiple projects at the same time.
    • Ability to handle confidential and sensitive information with professionalism and maturity.

               

    POSITION QUALIFICATIONS:

    • J.D. from an accredited law school
    • Must be licensed to practice in the state of Illinois or eligible to be licensed in the state of Illinois within a reasonable, predetermined timeframe.
    • 3-5 years legal experience required; in-house experience preferred.
    • Prior experience drafting and negotiating service agreements
    • Higher education experience preferred.
